Unlike in schools and universities, there is as yet no blanket licence covering the use of music within TAFEs. Until such an agreement is reached between TAFEs and the relevant collecting socities such as APRA|AMCOS, ARIA and PPCA, you are still obliged to make sure that all performances, reproductions, communications and adaptations of copyright works are licensed under the standard commercial licence schemes.
When will there be a licence?
APRA, AMCOS and ARIA are currently in discussions with the Copyright Advisory Group (CAG) to explore a blanket licence solution for TAFEs to cover the use of music and sound recordings.
What to do in the mean time
There are various business licences and statutory provisions that TAFEs can rely on for their music use.
Music in the Classroom
Under educational provisions in the Copyright Act (1968), TAFEs are permitted to play music in a classroom context and to reproduce or adapt musical works by hand only for educational use, for example melodic analysis on a white board. If your use goes beyond this you will likely need a Casual Performance Licence as below.
Copying Music
TAFEs can sometimes rely on the provisions of a licence administered by the Copyright Agency Limited (CAL) for the limited copying and communication of works, including some music. For more information regarding the extent of these provisions, please visit CAL’s website (www.copyright.com.au).

There are a number of business licences available from APRA|AMCOS that will authorise the use of music by your college or institution.

As APRA|AMCOS is limited in the licensing we can provide to TAFEs, our research services can help to put you in touch with copyright owners if you want to do the following:
- Make copies of commercial recordings
- Synchronise music with video
- Perform Grand Rights works (musicals, operas, ballets, pantomimes, etc.)
- Perform works in a Dramatic Context (such as plays)
- Photocopy or arrange sheet music.
